These Terms & Conditions explain the rules, responsibilities, and expectations that apply when you access our website, book services, purchase memberships or class packs, participate in training, receive clinic services, or otherwise interact with Driftwood Athletics.
 
By using our website, booking an appointment, purchasing a membership, attending a class, participating in training, receiving clinic services, or using our facilities, you agree to these Terms & Conditions.
 
If you do not agree with these Terms, please do not use our website, book services, purchase memberships, or participate in Driftwood Athletics programs.
 
1. Who We Are
 
Driftwood Athletics provides fitness, training, rehabilitation, and health-related services in Burnaby, British Columbia.
Our services may include CrossFit classes, fitness classes, strength and conditioning, Olympic lifting, personal training, sports team training, kids fitness, physiotherapy, kinesiology, registered massage therapy, nutrition and dietetics, athletic therapy, ICBC active rehab, injury rehabilitation, and related services.
 
We operate through in-person facilities, online booking platforms, third-party scheduling systems, and our website.

2. Use of Our Website
 
You may use our website for lawful personal and informational purposes only.
 
You agree not to:
 
Use the website for fraudulent, unlawful, harmful, or abusive purposes.
Attempt to interfere with the security, operation, or performance of the website.
Copy, scrape, reproduce, or misuse website content without permission.
Upload or transmit malicious code, spam, or harmful material.
 
Use our website in a way that violates the rights of Driftwood Athletics, our staff, our clients, or any third party.
 
We may update, restrict, suspend, or discontinue any part of the website at any time without notice.
 
3. Booking Platforms and Third-Party Services
 
Driftwood Athletics uses third-party platforms to support scheduling, payments, memberships, communication, forms, and service management.
 
These may include:
 
Mindbody for gym memberships, class bookings, class packs, fitness purchases, attendance tracking, and related fitness services.
 
JaneApp for clinic bookings, intake forms, appointment management, clinical records, billing, and health-related services.
 
Wix for website hosting, website forms, and website functionality.
 
Payment processors and other business tools used to process payments, manage services, or communicate with clients.
 
When you use a third-party platform, you may also be subject to that platform’s own terms, privacy policy, payment rules, cancellation rules, and account requirements. Driftwood Athletics is not responsible for third-party platform outages, errors, payment processing delays, account access issues, or changes to third-party platform policies.
 
4. Accounts and Booking Information
 
To book certain services, purchase memberships, buy class packs, or manage appointments, you may need to create an account through Mindbody, JaneApp, or another approved booking platform.
 
You agree to provide accurate, current, and complete information when creating an account, booking a service, completing intake forms, purchasing a service, or communicating with us.
 
You are responsible for keeping your login details secure and for all activity under your account.
If your contact, billing, health, injury, insurance, or emergency contact information changes, you are responsible for updating it before participating in services.
 
5. Health, Fitness, and Participation Risk
 
Participation in fitness, training, rehabilitation, and physical activity involves inherent risks.
 
These risks may include soreness, fatigue, muscle strain, joint pain, falls, aggravation of existing injuries, new injuries, illness, cardiovascular events, or other physical or medical complications.
 
By participating in Driftwood Athletics services, you acknowledge and agree that:
 

  • Physical activity carries risk.

  • You are responsible for participating within your abilities.

  • You must tell your coach, clinician, trainer, or practitioner about relevant injuries, pain, health conditions, limitations, medications, or concerns before participating.

  • You must stop activity and notify staff if you experience pain, dizziness, shortness of breath, chest pain, unusual symptoms, or any other concerning issue.

  • You should consult a physician or appropriate healthcare professional before beginning exercise if you have medical concerns or have been advised not to participate in physical activity.

  • Our team may modify, scale, pause, or refuse participation where we believe it is appropriate for safety, clinical, professional, or operational reasons.
     

6. No Guarantee of Results

Driftwood Athletics is committed to providing high-quality coaching, training, treatment, and support. However, results vary by individual.

We do not guarantee specific outcomes, including but not limited to:

  • Pain relief.

  • Injury recovery timelines.

  • Fitness improvements.

  • Strength gains.

  • Weight loss or body composition changes.

  • Return-to-sport outcomes.

  • Performance improvements.

  • Clinical outcomes.

  • Membership satisfaction.
     

Your results depend on many factors, including consistency, effort, health status, medical history, sleep, nutrition, lifestyle, adherence to recommendations, and factors outside our control.

7. Clinic Services

Clinic services may include physiotherapy, registered massage therapy, kinesiology, athletic therapy, nutrition and dietetics, ICBC active rehab, injury rehabilitation, and related health or wellness services.

Clinic services are provided by qualified professionals within their applicable scope of practice.

You agree to:
 

  • Provide complete and accurate health information.

  • Update your practitioner if your condition changes.

  • Follow safety instructions and clinical recommendations.

  • Ask questions if you do not understand your treatment plan.

  • Understand that healthcare services require informed consent.
     

Practitioners may determine that a service is not appropriate for you and may refer you to another provider, recommend medical follow-up, modify care, or decline to provide treatment where clinically appropriate.

8. Fitness, Classes, and Coaching Services

Fitness and coaching services may include CrossFit, group classes, personal training, strength and conditioning, Olympic lifting, bootcamp, kids fitness, sports team training, and related programs.

You agree to:
 

  • Arrive on time and prepared.

  • Follow coach instructions.

  • Use equipment safely and respectfully.

  • Scale workouts appropriately.

  • Respect other members, staff, and facility rules.

  • Tell staff about injuries or limitations before class.

  • Not participate while impaired by alcohol, recreational drugs, or any substance that could affect safety.


Driftwood Athletics may remove or restrict participation if behaviour is unsafe, disruptive, disrespectful, discriminatory, harassing, or inconsistent with our community standards.

9. Memberships, Class Packs, and Purchases

Memberships, class packs, drop-ins, bootcamps, personal training packages, kids classes, and other fitness purchases may be sold through Mindbody or another approved platform.

By purchasing, you agree to the price, billing terms, renewal terms, expiry dates, cancellation rules, refund rules, and usage conditions shown at checkout or communicated by Driftwood Athletics.

Unless otherwise stated:
 

  • Memberships and packages are for the named purchaser only.

  • Memberships and class packs may not be shared, transferred, resold, or assigned without written permission.

  • Unused classes or sessions may expire according to the terms shown at purchase.

  • Promotions, discounts, and special offers may be limited, changed, or discontinued at any time.

  • Prices may change with notice where required.

  • If a payment fails, your access to classes, bookings, or membership benefits may be suspended until payment is resolved.


10. Recurring Billing

Some memberships or services may renew automatically.

If you purchase a recurring membership, you authorize Driftwood Athletics or its payment processor to charge your selected payment method according to the billing schedule shown at purchase.

You are responsible for keeping your payment method current.

If your payment fails, we may attempt to process payment again, contact you for updated payment information, suspend your membership, or apply applicable administrative rules.

To cancel or change a recurring membership, you must follow the cancellation process provided at purchase, in Mindbody, or by contacting Driftwood Athletics.

11. Cancellations, Late Cancels, and No-Shows

Cancellations, late cancellations, and no-shows may be subject to rules that vary by service type, practitioner, class, membership, or platform.

Class bookings, clinic appointments, personal training sessions, and other services may have separate cancellation windows.

If you cancel late or do not attend a booking, you may be charged a fee, lose the session, forfeit the class, or be subject to other account restrictions.

For clinic appointments, late cancellations or no-shows may be charged according to the clinic cancellation policy shown in JaneApp, communicated at booking, or provided by Driftwood Athletics.

For classes and fitness services, cancellation and no-show rules may be shown in Mindbody or communicated by Driftwood Athletics.

12. Refunds

All purchases are subject to the refund rules shown at the time of purchase or communicated by Driftwood Athletics.

Unless required by law or expressly stated otherwise:
 

  • Memberships, class packs, drop-ins, personal training packages, bootcamps, and promotional purchases may be non-refundable.

  • Used services are not refundable.

  • Missed classes, late cancellations, and no-shows are not refundable.

  • Refunds, credits, transfers, or extensions may be approved at our discretion.

  • Medical, relocation, injury, pregnancy, or exceptional circumstances may be reviewed case-by-case, but approval is not guaranteed.

  • Approved refunds may be returned to the original payment method and may take time to process depending on the payment provider.
     

13. Holds, Pauses, and Extensions

Membership holds, pauses, package extensions, and account credits may be available only where permitted by the specific membership or package terms.

Requests must be submitted before the requested hold or extension period whenever possible.

Driftwood Athletics may require supporting information for extended holds or special requests.
We may approve, deny, limit, or modify hold and extension requests at our discretion, subject to applicable law.

14. Direct Billing and Insurance

Driftwood Athletics may offer direct billing for certain clinic services where available.

Direct billing is not guaranteed.

Insurance coverage depends on your insurer, plan, practitioner type, service type, claim rules, policy limits, and eligibility.

You are responsible for:
 

  • Confirming your own insurance coverage.

  • Providing accurate insurance information.

  • Paying any portion not covered by insurance.

  • Paying if a claim is denied, reversed, delayed, partially paid, or rejected.

  • Direct billing is a convenience, not a guarantee of payment.
     

15. ICBC, WorkSafeBC, and Third-Party Claims

Certain services may be eligible for billing through ICBC, WorkSafeBC, or another third-party payer where applicable.

Eligibility, coverage, number of visits, approval requirements, and payment rules are determined by the third-party payer.

You are responsible for providing accurate claim information and for paying any amounts not covered, denied, or reversed.

Driftwood Athletics may refuse, pause, or modify third-party billing if required information is missing, coverage is unclear, claims are denied, or administrative requirements are not met.

16. Minors and Youth Programs
Some services may be available to minors, including kids fitness, youth training, rehabilitation, or clinic services.

A parent or legal guardian may be required to:
 

  • Provide consent.

  • Complete waivers or intake forms.

  • Accept financial responsibility.

  • Provide emergency contact details.

  • Disclose relevant health or behavioural information.

  • Follow pickup, drop-off, supervision, and facility rules.
     

Driftwood Athletics may determine whether a minor’s participation is appropriate based on age, maturity, safety, program type, and staff assessment.

17. Facility Rules

When using Driftwood Athletics facilities, you agree to:
 

  • Treat staff, members, patients, visitors, and property with respect.

  • Follow posted rules and staff instructions.

  • Use equipment only as instructed.

  • Clean up after yourself.

  • Report damage, hazards, injuries, or unsafe conditions.

  • Wear appropriate clothing and footwear.

  • Avoid filming or photographing others without permission.

  • Respect privacy in clinic, washroom, change, and treatment areas.

  • Not engage in harassment, discrimination, intimidation, violence, threats, or abusive behaviour.

  • We may suspend or terminate access for unsafe, disrespectful, unlawful, or disruptive behaviour.
     

18. Personal Belongings

You are responsible for your own belongings while at Driftwood Athletics.

We are not responsible for lost, stolen, or damaged items, including phones, wallets, keys, clothing, bags, equipment, or valuables.

Please do not leave valuables unattended.

19. Photos, Videos, and Media

Driftwood Athletics may take photos or videos for educational, promotional, social media, website, or community purposes.

We will make reasonable efforts to obtain consent where identifiable individuals are featured in promotional content.

You may not take photos or videos of other members, patients, clients, staff, or visitors without their permission.

No filming or photography is permitted in private treatment areas, washrooms, change areas, or other privacy-sensitive spaces unless approved by a staffer at Driftwood Athletics.

If you do not want to appear in Driftwood Athletics media, please tell us in writing.

20. Website Content and Educational Information

Content on our website, social media, emails, blog posts, videos, and educational materials is for general informational purposes only.

It is not a substitute for individualized medical advice, diagnosis, treatment, physiotherapy assessment, exercise prescription, or professional healthcare advice.

Do not ignore medical advice or delay seeking medical care because of something you read or watch from Driftwood Athletics.

If you have an emergency or urgent medical concern, contact emergency services or seek immediate medical attention.

21. Intellectual Property

All website content, branding, logos, text, photos, videos, graphics, designs, workouts, programs, resources, documents, and materials created by Driftwood Athletics are owned by Driftwood Athletics or used with permission.

You may not copy, reproduce, distribute, modify, sell, publish, or use our materials for commercial purposes without written permission.

You may share public website links or social media posts in a reasonable personal manner, provided you do not alter the content or misrepresent Driftwood Athletics.

22. User Submissions and Communications

If you submit information through forms, email, booking platforms, social media, or other communication channels, you agree that the information is accurate and appropriate.

You must not submit unlawful, abusive, defamatory, misleading, discriminatory, harassing, or harmful content.

We may respond to communications at our discretion and are not required to monitor or respond to every message.

24. Electronic Communications

By providing your email address, phone number, or contact details, you agree that Driftwood Athletics may contact you about bookings, account matters, purchases, service updates, reminders, administrative issues, and related communications.

You may also choose to receive marketing communications, newsletters, promotions, or updates.
You may unsubscribe from marketing communications where required by law.

Transactional, booking, billing, safety, or service-related communications may still be sent even if you opt out of marketing communications.

25. Limitation of Liability

To the maximum extent permitted by law, Driftwood Athletics, its owners, directors, employees, contractors, coaches, practitioners, representatives, and service providers are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of our website, services, facilities, classes, memberships, appointments, third-party platforms, or communications.

Nothing in these Terms limits liability where it cannot be limited by law.

These Terms do not replace any separate waiver, informed consent, intake form, membership agreement, or platform-specific agreement you may sign or accept.

26. Assumption of Risk and Waivers

You may be required to sign or accept additional waivers, informed consent forms, intake forms, health forms, membership agreements, or platform terms before participating in certain services.
If there is a conflict between these Terms and a more specific signed or accepted agreement, the more specific agreement may apply to that service or situation.

Participation may be denied if required forms are incomplete, inaccurate, unsigned, or not accepted.

27. Service Availability

We may change, suspend, cancel, or discontinue services, classes, schedules, practitioners, coaches, prices, locations, hours, programs, booking availability, or website content at any time.

We are not responsible for delays, cancellations, closures, or service interruptions caused by events outside our reasonable control, including emergencies, weather, illness, staffing shortages, facility issues, platform outages, public health orders, power outages, or other unexpected events.

Where appropriate, we may provide credits, rescheduling options, or alternative arrangements at our discretion.

28. Termination or Suspension

We may suspend or terminate access to services, memberships, bookings, facilities, accounts, or website features if you:
 

  • Violate these Terms.

  • Fail to pay amounts owing.

  • Provide inaccurate or misleading information.

  • Act in a way that is unsafe, abusive, discriminatory, harassing, threatening, or disruptive.

  • Misuse our facilities, equipment, website, booking systems, or services.

  • Violate staff instructions, professional boundaries, or community standards.
     

Suspension or termination does not automatically create a right to a refund.

We make reasonable efforts to keep our website, pricing, schedules, descriptions, and policies accurate.
